By accessing or using Musica ("the Service"), operated by Musica Technologies ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and the Company. We reserve the right to modify these Terms at any time, and your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
Musica is an AI-powered Latin music generation platform that allows users to create original music compositions using artificial intelligence. The Service includes:

We may suspend or terminate accounts that we believe contain false or misleading information or are being used in violation of these Terms.
Musica offers the following subscription plans:
All payments are processed securely by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
Credits: Each music generation consumes credits based on duration and quality settings. Credits do not roll over between billing periods. We reserve the right to adjust credit allocations with reasonable notice to subscribers.
Refund Policy: Subscription fees are generally non-refundable. If you believe you were charged in error, contact [email protected] within 14 days of the charge. We may issue refunds at our sole discretion for verified billing errors.
Your Ownership:Subject to these Terms, you retain ownership of any original content you provide as input to the Service, including lyrics and descriptive prompts ("User Input"). However, because the musical output is primarily AI-generated, ownership of the final audio output ("Generated Content") is subject to the terms below.
License to Musica: By using the Service, you grant Musica a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute your Generated Content on the platform, including on the public feed and explore sections, unless you set your songs to private.
Your Responsibility: You are solely responsible for any User Input you provide. You represent and warrant that your User Input does not infringe any third-party rights, including intellectual property rights, and does not violate any applicable laws.
Commercial Use: Commercial use rights are granted to Pro and Premier plan subscribers. Free plan users may use Generated Content for personal, non-commercial purposes only.
The music generated through our Service is produced by artificial intelligence models. You acknowledge and agree that:
Musica retains ownership of the underlying AI models, training infrastructure, and platform technology used to generate music.
You agree not to use the Service to:
Violation of these prohibitions may result in immediate account termination and, where appropriate, referral to law enforcement.
Zero Tolerance Policy
Musica maintains a zero-tolerance policy for objectionable content and abusive users. There is no tolerance for content that is hateful, discriminatory, sexually explicit involving minors, or that promotes violence or terrorism. Users may report objectionable content or abusive behavior at any time through the in-app reporting feature. Musica will review and act on all reports within 24 hours, which may include removing the content and terminating the account of the offending user. Users may also block other users at any time, which will immediately remove that user's content from their feed.
The Musica platform, including its design, software, AI models, branding, trademarks, logos, and all content created by Musica (excluding User Content), is owned by Musica Technologies and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any Musica-owned content without our express written permission.
The "Musica" name, logo, and related marks are trademarks of Musica Technologies. Nothing in these Terms grants you any right to use our trademarks.
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.
We reserve the right to suspend or terminate your account and access to the Service at any time, for any reason, including but not limited to:
You may terminate your account at any time through the Settings page. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including provisions on intellectual property, disclaimers, and limitation of liability.
Disclaimer of Warranties:THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MUSICA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
